The SBA's primary concern for franchise eligibility is the enforceability of the franchise agreement and the franchisor's relationship with its U.S. franchisees, not the franchisor's country of origin. If the franchise agreement is compliant with SBA requirements and the franchise is listed on the SBA Franchise Directory, the foreign origin of the franchisor does not automatically disqualify the U.S.-based franchisee for a 7(a) loan.
An applicant wishes to open a coffee shop operating under a well-known Canadian franchise brand. The lender confirms the Canadian franchisor's U.S. franchise agreement is on the SBA Franchise Directory. Provided the U.S. business meets all other 7(a) eligibility criteria, the loan can proceed.
