If project costs increase after closing, the lender cannot unilaterally increase the authorized loan amount. A new E-Tran submission, indicating an 'amendment,' is required. The lender must justify the increase, verify the new total project cost, ensure the borrower remains eligible, and confirm the additional funds are for an eligible use of proceeds and adequately collateralized. The increase must be approved by the SBA.
Post-closing, a construction project financed by a 7(a) loan faces unforeseen material cost increases of $50,000. The lender prepares an amendment request, updates the E-Tran system, provides new invoices, and ensures the borrower's financials can support the increased debt service before submitting to the SBA for approval.
