For SBA lenders
Short answer
Lenders can release collateral on a 7(a) loan without prior SBA approval if the release is for adequate consideration and consistent with prudent lending standards, typically when the remaining collateral provides sufficient security.
Lenders have unilateral authority to release collateral when the net proceeds from the sale are applied to the loan balance, or when the value of the remaining collateral is still sufficient to protect the loan. The Servicing and Liquidation Actions 7(a) Lender Matrix provides specific thresholds and conditions under which prior approval is not required, such as releases for less than $250,000 when the loan is not in default.
A borrower wants to sell a piece of equipment used as collateral for $50,000. The loan is current, and the remaining collateral far exceeds the outstanding balance. The lender can approve this release without SBA permission, applying the $50,000 net proceeds to the loan.
Insider move
Lenders must document the rationale for collateral releases, ensuring that the remaining collateral adequately secures the loan and that the release is for fair value. Improper releases without SBA approval, especially if the loan is impaired, can lead to guaranty repairs or denials.
