For SBA lenders
Short answer
An Environmental Questionnaire (Form 1081) is required for all 7(a) loans, even those not involving real estate acquisition, if the loan proceeds will be used for specific purposes like construction, renovation, or if the business activity itself has a high environmental risk (e.g., dry cleaners, gas stations).
SBA environmental policies extend beyond real estate collateral to the business operations themselves. Form 1081 helps lenders identify potential environmental risks associated with the business's industry, location, or proposed use of funds, even if real estate isn't being purchased.
A $300,000 7(a) loan is for working capital and equipment for an existing auto repair shop located in leased premises. Even though no real estate is being acquired, the lender would require Form 1081 because auto repair shops are considered a high-risk industry due to potential hazardous waste.
Insider move
Lenders must ensure environmental due diligence is performed whenever there is an environmental risk, not just for real estate purchases. Failure to complete Form 1081 or to act on information gathered can lead to undisclosed environmental liabilities and potentially affect guaranty recoverability.
