Yes, an SBA 7(a) loan can have a prepayment penalty if the original loan term is 15 years or longer and the loan is paid off within the first three years.
The SBA specifies prepayment penalties only for loans with maturities of 15 years or more, and only if the loan is prepaid within the first three years. The penalty amount decreases over these three years (5% in year 1, 3% in year 2, 1% in year 3). Loans with terms under 15 years or prepaid after three years have no penalty.
A business takes out a $1,000,000 SBA 7(a) loan with a 25-year term. If they pay it off after 18 months, they would incur a 3% prepayment penalty on the outstanding balance. If they pay it off after 4 years, there is no penalty.
