Short answer
It depends. Your spouse usually needs to sign a personal guarantee if they own 20% or more of the business, or if the business is located in a community property state, even if they are not an owner.
The SBA requires all owners with 20% or more equity in the applicant business to provide a full personal guarantee. Additionally, in community property states, the spouse of a principal owner (regardless of their ownership percentage) must also sign the personal guarantee. This is to ensure that community assets are available for loan repayment if needed, as state laws dictate marital property rights.
In California, a community property state, John owns 100% of his business. His wife, Mary, who owns 0% of the business, would still be required to sign a personal guarantee for his SBA 7(a) loan to bind their community assets.

Lenders must identify all individuals required to provide a personal guarantee, especially in community property states, to ensure the guarantee is enforceable. Failure to obtain all required guarantees can jeopardize the SBA guarantee in case of default.
