Short answer
A business is speculative if its success depends on predicting future fluctuations in value, such as real estate investment firms, oil and gas exploration, or businesses primarily engaged in gambling.
The SBA's mission is to support small businesses engaged in legitimate, non-speculative commercial activities. Businesses whose primary purpose involves speculation in commodities, real estate, or other ventures with uncertain future values are generally ineligible because they pose higher inherent risks inconsistent with the program's objectives.
An applicant seeks a 7(a) loan to purchase raw land with the intention of holding it until its value increases, then reselling it. The lender would deem this ineligible as a speculative real estate investment, not an operating business.
Insider move
Lenders must carefully review the business plan and proposed use of proceeds to ensure the business is not primarily engaged in speculative activities. Mischaracterizing a speculative business as an eligible one can lead to immediate loan denial or guaranty repair.
